Bhilai. Earned Leave Encashment facility for all employees of SAIL including Bhilai Steel Plant has been restored as before. Its order was issued from SAIL Headquarters. In the order, all employees and officers have been given the facility of encashment of leave up to a maximum of 30 days of earned leave or 50 percent of the total earned leave.
Along with this, the old condition has been removed, in which only 25 percent of the employees were getting the benefit. This matter of leave encashment was also going on in Jabalpur Industrial Court and hearing was also held recently. After this, its order was issued at the cell level in a hurry. Now all 16500 BSP personnel, 26 hundred officers will be able to get its benefit.
Due to financial crunch in SAIL in the last year 2015, the management had put a condition in this while discontinuing the Earned Leave Encashment Facility (EL Encashment). Due to which very few employees and officers were able to take advantage of this facility. Employees were constantly demanding to start it as before. The Ispat Shramik Manch and AITUC Union of Bhilai had also filed an industrial complaint against the unilateral decision of the management. After the failure of the conciliation talks, the Ispat Shramik Manch filed an industrial family under Section 9A in the Jabalpur Labor Court.
Tushar Rai Choudhary appeared on behalf of the management in the Jabalpur Tribunal Court on August 31. On behalf of Ispat Shramik Manch, advocate Michael Pradeep had defended the union. The Management had failed to give satisfactory reply in the matter. After which the management has given relief to the workers by restoring the facility even before the final decision was to come in the next hearing.
Despite SAIL issuing an order to restart the process of Earned Leave encashment, the employees are making up their mind to wait for the wage settlement. The main reason behind this is the non-receipt of arrears on the amount of EL encashment. If an employee is now encashing leave, in that case he will get encashment only on the basis of old salary.
In the Jabalpur Tribunal Court, the management had also mentioned the process started last year for encashment of earned leave. In which only senior employees benefited. Expressing strong objection to this, Michael Pradeep, counsel for Ispat Shramik Manch, had told the court, while defending the workers, that when the facility is snatched from everyone, then the restoration of some people cannot be considered as relief. In a hurry, only about 3000 employees and 700 officers were coming under the ambit of earned leave encashment scheme launched by the management. For the rest of the employees, the 170-day entitlement was depriving them of economic benefits.
Rajesh Aggarwal, general secretary of Ispat Shramik Manch, said that in protest against the unilateral decision of the management, our union had filed an industrial family under Section 9A in the Jabalpur Labor Court. Its hearing was held on August 31, the management could not even answer it. This is a victory for the employees.
INTUC Additional Secretary General Sanjay Sahu said that efforts were being made by INTUC at the SAIL level to ensure that all employees should get the facility of leave encashment. The financial condition of SAIL has improved as compared to earlier. Employees have got their due.
SAFI President Narendra Kumar Banchore said that now all the employees can encash their earned leave. Sefi was relentlessly striving for this. As a result of which earlier there was facility of payment only on accumulation of more than 270 earned leave.
